Will prison time be a factor in a marijuana intent to sell charge if marijuana is legal in the residing state?

My husband was picked up yesterday by police in Long Beach, CA, for two counts of possession to sell. His bail is set at 20,000.00 and I'm currently working with a bondsman. The weight/amount in total was under a half-ounce of marijuana. Being that Marijuana is legal in CA, will he face prison time?

    Marijuana is not legal in CA. It has reduced penalties, but possession for sale is illegal.

    Marijuana is NOT legal in CA, and he is charged with one or more felonies that carry prison time upon conviction. His PC card is not a factor or defense in these charges. You should consider hiring an attorney with your funds, rather than a bondsman. The attorney may be able to get an OR release, or at least a reduced bail.

    Marijuana is not legal in California and to the extent that it is a defense to possession of marijuana that it is used for medicinal purposes, it is still illegal to sell it or possess it for sale. Even marijuana dispensaries are on the edge of the law when they are permitted by the local jurisdiction.
