You are looking at both a criminal action for DUI and a Civil action for damages. You will need a DUI attorney and notify your Insurance Company they will defend you against the civil suit.

It depends on a couple of issues. First, it depends on the seriousness of the injuries. If the head injuries in particular are serious, you could be looking at the felony charge of Vehicular Assault. Should the victim die, you would be facing Vehicular Homicide charges. The second issue is your prior criminal history. Were you to have prior felony charges or DUI convictions, you would be facing a more serious sentence than someone with no criminal convictions. Now, there are some avenues of defense possible. One might be causation. If your intoxication did not cause the injuries, you may have a defense. You may also prove you were not intoxicated. Did the police conduct a blood draw? Why don't you give me a call and we can discuss this situation in confidence. It may be you are in deep trouble or may be facing a single day in jail. It all depends on the evidence.
