Is identity theft a misdemeanor or felony?

My brother used a coworker's social security number and information to open up credit cards. He ended up ruining this person's credit and I am guessing that he is going to go to jail. He has been in a really bad place since developing a nasty drug problem and now he's reached rock bottom. Am I right in assumin that this is a felony charge and that he is going to go to jail?
