Can a cop of the opposite sex search me?

My friend got pulled over and the cop made everyone get out of the car. He searched all of us by patting us down and reaching into our pockets. Me and another girl requested a female cop and he said no. They found a bowl on me. Can I get out of it because the cop was a guy and he can't search a girl?

    No that is not illegal but they usually do search with officers of the same sex to avoid charges of impropriety.

    I am actually more concerned about the reaching into pockets than I am the gender of the officer. You should speak to a criminal defense attorney who can ask you follow up questions and review the officer's report as well. There may be a good basis for a suppression motion here.

    You can file a complaint against the officer, and deal with the complaint while you are serving jail time for the bowl. One has nothing to do with the other.
