The trial of a Cedar Falls, Iowa man, accused of killing a police officer, was postponed after his attorney was dismissed. William Filippo’s attorney, Judith O’Donohoe, was dismissed because she had represented the state trooper in another matter.
One of the most basic rules in the legal system is that a lawyer cannot represent a client when she has represented anyone else involved in the case. Every lawyer is required to have a system whereby she checks to see if she has a conflict of interest. O’Donohoe’s system must have failed.
Filippo was to go on trial for attempted murder, assault on a police officer, and eluding. He is accused of trying to run over a trooper during a chase. The trooper then shot Filippo.
