The US Supreme Court has rejected a wrongful-arrest lawsuit against the City of Chicago Illinois because it was filed too late. Andre Wallace was arrested in 1994 and charged with murder. Wallace filed his wrongful-arrest suit in 2003, a year after he won an appeal and was released from prison.
By a 7-2 decision, the Court upheld a ruling by the 7th Circuit Court. The Court’s ruling upheld a two year limit to file a wrongful-arrest suit. Wallace was required to file his suit within two years of his 1994 arrest.
The Court also threw out a lawsuits by Leroy Orange and Courtney White because they were filed after the two year deadline.
The moral of this story is … Don’t wait to prove you’re innocent, file that lawsuit now.
